The DOLE has recently issued the Implementing Rules and Regulations of Republic Act No. 10757 “An Act Reducing The Retirement Age of Surface Mine Workers From Sixty (60) to Fifty (50) Years, Amending For The Purpose Article 302 Of PD No. 442, as amended, otherwise known as The Labor Code Of The Philippines” from 60 years old.
The law also amends the retirement articles under the Labor Code and the Social Security Act by stating that miners upon the age of 50 may retire and would be entitled to retirement benefits. It added that the retirement clause applies to surface miners who should have served at least five (5) years before their retirement.
The Department of Labor and Employment (DOLE) through the Bureau of Working Conditions (BWC) drafted the Implementing Rules and Regulations after a long and tedious consultation with the different stakeholders from the labor and employer groups as well as from the government. The Rule took effect on April 27, 2016 when Republic Act 10757 went into force.
The IRR is replete with information on its coverage, who is qualified under the law, retirement benefits, computation of retirement pay, entitlement of benefits under the Social Security System, rules on retirement age as well as its penal provision.
